Terms of Service

These Terms govern use of monecuer.com and Monecuer services unless a product-specific agreement, quotation, statement of work or other written agreement says otherwise.
1. Agreement
By using a Monecuer website, product or service, you agree to these Terms and any additional terms presented for that product or engagement. If you do not agree, do not use the relevant service.
2. Services
Monecuer provides technology, software, digital systems, security-focused engineering, media production and related professional services. Available services, features and delivery methods may change as the company develops. A public website description is not a promise that every capability is available for every engagement.
3. Project agreements
For paid project work, scope, deliverables, timelines, fees, revisions, ownership, support and acceptance criteria should be defined in the applicable quotation, invoice, statement of work, contract or written confirmation. Where those documents conflict with these general Terms, the more specific written agreement controls for that engagement.
4. Payments
Clients are responsible for paying agreed fees according to the payment schedule stated in the applicable quotation, invoice or agreement. Work may be paused when required payments are overdue. Taxes, transaction fees or third-party costs are handled as stated in the relevant agreement.
5. Client responsibilities
Clients must provide accurate requirements, lawful content, required permissions, timely feedback and access reasonably needed to complete an engagement. Delays in approvals, missing materials or scope changes may affect delivery dates and pricing.
6. Intellectual property
Monecuer retains rights in its pre-existing software, tools, frameworks, methods, brand assets and reusable components. Ownership or licensing of project-specific deliverables is determined by the applicable written agreement. Clients remain responsible for ensuring they have rights to material they provide to Monecuer.
7. Acceptable use
You may not use Monecuer services to violate law, infringe rights, distribute malware, conduct unauthorized access, abuse infrastructure, send unlawful spam, facilitate fraud or interfere with service availability. Additional restrictions appear in our Acceptable Use Policy.
8. Privacy
Personal information submitted through Monecuer websites is handled as described in our Privacy Policy. Product-specific notices may apply to particular applications.
9. Third-party services
Some Monecuer services rely on third-party platforms, hosting providers, app stores, APIs or infrastructure. Their availability and terms may affect the relevant service. Monecuer is not responsible for outages or changes controlled solely by an independent third party, except to the extent required by applicable law or a written agreement.
10. Warranties and availability
Except where a written agreement expressly provides otherwise, services are provided on an “as available” basis. Monecuer does not promise uninterrupted operation, a particular commercial result, or compatibility with every device, platform or third-party service.
11. Limitation of liability
To the maximum extent permitted by applicable law, Monecuer is not liable for indirect, incidental, special or consequential losses arising from use of the services. Any contractual liability cap or additional remedy for a paid engagement will be determined by the applicable written agreement.
12. Suspension and termination
We may suspend access where reasonably necessary to protect security, prevent abuse, comply with law, address non-payment or enforce these Terms. Project termination rights and handover obligations may also be defined in the relevant engagement agreement.
13. Governing law
Unless a written agreement specifies another governing law or dispute process, these Terms are governed by the laws applicable to Monecuer Inc in Zimbabwe, subject to any mandatory rights that apply to you in your jurisdiction.
